<h2>1. Duration of the Rental Agreement</h2>
<p>The rental agreement applies to the vehicle specified on the front page of this contract for the time period indicated. The vehicle must be returned no later than the agreed time.</p>
<p>Return is considered completed when both the vehicle and the car keys are in the possession of the rental company during the rental station&rsquo;s regular opening hours. If the vehicle and car keys are returned outside the rental station&rsquo;s regular opening hours, the return will be deemed to have occurred on the next working day. If there is a valid reason, the rental company may require the vehicle to be returned earlier than agreed. The renter may request the reason, although this does not affect the obli...</p>
<p>The rental company has the right to retrieve the vehicle after the agreed rental period has expired, pursuant to the Enforcement Act, Chapter 13, &sect;13-1. The costs associated with this shall be covered by the renter.</p>
<p>If the agreed return time is exceeded or there is any other serious breach of the rental terms, any discount, insurance, or special agreement may be canceled by the rental company.</p>
<h2>2. Renter&rsquo;s Responsibility</h2>
<p>During the rental period, and until the vehicle is returned to the rental company, the renter bears full responsibility for the vehicle and its use.</p>
<p>The renter is obliged to pay the following:</p>
<ul>
<li>The rental price as agreed in the rental agreement.</li>
<li>Insurance premiums as agreed in the rental agreement.</li>
<li>Payment for mileage as agreed in the rental agreement.</li>
<li>Unrefilled fuel, with a surcharge of 20% compared to the recommended price, or a higher surcharge and/or fee if stated on the front page of the rental contract.</li>
<li>One-way rental charges, if this is agreed in the rental contract.</li>
<li>Any costs related to returning the vehicle to a different location than originally agreed upon.</li>
<li>Any costs related to tolls, road pricing, or similar, plus VAT and any margin added by the rental company.</li>
<li>Parking tickets or other fees, charges, fines, or other penalties where the vehicle owner (the rental company) is jointly liable with the driver (the renter).</li>
<li>Any damage to the vehicle during the rental period, including vandalism and theft, though limited to the agreed deductible. One deductible applies per damage incident.</li>
<li>Extraordinary cleaning costs for excessively soiled vehicles (e.g., due to animals, smoking, mud, or roadwork residue), both inside and outside, requiring special effort.</li>
<li>Loss of use, based on insurance company rates &mdash; i.e. the financial loss incurred by the rental company while the vehicle is out of service.</li>
<li>If the renter has acted negligently, violated the rental terms or the Road Traffic Act, they may be required to pay more than the agreed deductible.</li>
<li>In cases of intent, gross negligence, or serious violations of the rental terms or Road Traffic Act, the renter will be fully financially liable for all damages.</li>
<li>The rental company&rsquo;s expenses for debt collection, including all legal fees related to collection. In the event of late payment, late interest will accrue according to the Act on Interest on Overdue Payments of December 17, 1976, no. 100, from the due date until payment is made.</li>
</ul>
<h2>3. Renter&rsquo;s Duties</h2>
<h3>3.1. Duty to Inspect</h3>
<p>The renter is required, as far as possible, to inspect the vehicle immediately upon taking possession and ensure that all damages are noted on the rental agreement or an attachment.</p>
<p>The renter must familiarize themselves with the rules applicable to the specific vehicle as well as Norwegian traffic regulations in general.</p>
<p>Foreign renters have a particular duty to familiarize themselves with relevant driver&rsquo;s license requirements and rules regarding alcohol/medication use and traffic laws.</p>
<h3>3.2. Maintenance Responsibility</h3>
<p>During the rental period, the renter must ensure that the vehicle is maintained with regard to lubricating oils, coolant, tire pressure, and similar. In case of doubt about maintenance, the rental company should be contacted.</p>
<h3>3.3. Obligations Regarding Use of the Vehicle</h3>
<p>The renter must handle and use the vehicle responsibly and must not:</p>
<ul>
<li>Use the vehicle without ensuring they hold the necessary licenses for the vehicle type and intended use</li>
<li>Take the vehicle outside of the country without written consent from the rental company</li>
<li>Transport passengers for compensation</li>
<li>Use the vehicle for illegal purposes or in an illegal manner, including (but not limited to):</li>
<ul>
<li>Driving under the influence of alcohol and/or drugs or in a weakened condition</li>
<li>Carrying more passengers and/or heavier loads than the vehicle is registered for</li>
<li>Tampering with or altering the odometer</li>
</ul>
<li>Allow others to drive or operate the vehicle unless approved by the rental company</li>
<li>Use the vehicle in races, speed tests, or any form of performance testing</li>
<li>Use the vehicle for driving practice</li>
<li>Tow, push, or move other vehicles</li>
<li>Leave the vehicle unlocked or in a way that allows others to access and use it</li>
<li>Fill the tank with the wrong type of fuel</li>
<li>Remove or swap the toll tag</li>
<li>Secure or package cargo poorly, in a way that risks damage to the vehicle, people, or surroundings</li>
<li>Expose the interior to heat, sharp objects, or corrosive/staining substances</li>
<li>Drive with damaged tires/rims ("curb rash")</li>
<li>Park beneath rooftops with posted warnings of falling snow or obvious danger of roof slides</li>
<li>Use snow chains or other equipment in a way that damages the vehicle&rsquo;s body or undercarriage</li>
<li>Drive into spaces that are physically too small in height, width, or length for the vehicle</li>
<li>Drive off-road or in areas closed to public access</li>
</ul>
<h2>4. Rental Company&rsquo;s Duties</h2>
<p>The rental company is obliged to provide the vehicle to the renter at the agreed time and place.</p>
<p>The vehicle must be in good condition, compliant with applicable regulations, and contain at least 20 liters of fuel &mdash; or a charged battery for electric vehicles.</p>
<p>The rental company must ensure that the vehicle is covered by liability insurance in accordance with the Motor Vehicle Liability Act.</p>
<p>The rental company is required to inspect the vehicle for damage within 6 hours after it is returned. Any findings and/or claims must be reported to the renter within 24 hours after return. This time limit only applies during the station&rsquo;s opening hours. (See also Section 1.)</p>
<h2>5. Renter&rsquo;s Rights</h2>
<p>If the rental company significantly breaches its obligations under the agreement, the renter may terminate the rental contract. However, the rental company must be given a reasonable opportunity to remedy the breach, either by repair or replacement. If such measures are not possible or not implemented within a reasonable time after the renter has complained about the issue, the renter may demand a proportional price reduction.</p>
<p>The renter may claim compensation for losses suffered due to the rental company&rsquo;s breach, unless the company proves that the breach or its cause was due to an obstacle beyond its control &mdash; one which it could not reasonably have taken into account at the time of agreement, avoided, or overcome. Compensation for indirect losses &mdash; such as loss of income, operational downtime, loss of profit due to a third-party contract being cancelled or unfulfilled, or damage to property other than the rented vehicle &mdash; ...</p>
<p>The renter forfeits the right to claim breach of contract (whether delay or defect) if they do not notify the rental company within a reasonable time after the breach was discovered or should have been discovered.</p>
<p>Technical faults arising during the rental period, or discovered by the renter, that can be remedied within a timeframe reasonably related to the renter&rsquo;s needs and rental duration, do not entitle the renter to terminate the agreement. Should the renter choose to terminate the contract anyway, they remain liable for rent throughout the agreed period, with deductions for time that would have been required for repair.</p>
<p>The renter is also liable for any costs the rental company incurs in retrieving the vehicle. If repairs cannot be made within the stated timeframe, the rental company decides whether to provide a replacement vehicle or consider the agreement terminated from the time the renter reported the issue. In the latter case, the rental company arranges return of the vehicle at its own expense and is not liable for the renter&rsquo;s potential loss or obligations.</p>
<h2>6. Disclaimer of Liability</h2>
<p>The rental company assumes no responsibility for damage to, or loss of, property left, stored, or transported in the vehicle by the renter or any other person.</p>
<p>The rental company disclaims any liability for loss of time, money, or other inconvenience arising from or related to the rental agreement, beyond what is explicitly stated elsewhere in these terms.</p>
<p>The rental company is not responsible for installing additional equipment such as ski racks, child seats, GPS devices, etc. The renter is solely responsible for ensuring that such equipment is installed correctly and in accordance with applicable regulations.</p>
<h2>7. Security and Settlement</h2>
<p>The rental company may require the renter to provide security for the vehicle and for any financial obligations arising from the rental agreement. This security may take the form of a debit/credit card reservation, a bank deposit, a cash amount, or another form of deposit as agreed between the parties.</p>
<p>The renter accepts that the rental company may charge the renter&rsquo;s debit/credit card reservation or deposit for rental fees based on time and mileage, tolls, and other charges or fees, as well as fuel and any maintenance if applicable.</p>
<h2>8. Agreement Formalities</h2>
<h3>8.1 Amendments</h3>
<p>Any additions or changes to the terms of this agreement are only binding if made in writing and agreed upon by both parties.</p>
<h3>8.2 Governing Law</h3>
<p>This contract is governed by Norwegian law.</p>
<h3>8.3 Legal Venue</h3>
<p>The renter agrees that legal venue shall be the rental company&rsquo;s place of business where the contract was signed &mdash; i.e., the contractual venue pursuant to Section 4-5(2), cf. Section 4-6 of the Norwegian Dispute Act &mdash; for any disputes arising in connection with the rental relationship.</p>
